The firm successfully appealed a trial court's decision to dismiss a client's personal injury lawsuit, retaining the client’s right to seek justice and fair compensation.
The case stems from a collision on March 7, 2022, in which the plaintiff, represented by Albrecht Law, was rear-ended while stopped at a red traffic light. The at-fault driver claimed the crash was the result of an unforeseeable sudden medical emergency, specifically a stroke, and successfully moved the trial court to dismiss the case on summary judgment.
Refusing to accept the dismissal, the legal team at Albrecht Law appealed the decision. On October 21, 2025, the Court of Appeals agreed with Albrecht Law's arguments, ruling that genuine issues of material fact existed regarding whether the stroke actually caused the collision and whether the medical emergency was truly unforeseeable. The appellate court reversed the summary judgment, paving the way for the case to return to the trial court.
