Those rules have been in flux for nearly a year. A September 2025 presidential proclamation introduced a $100,000 fee on certain new H-1B petitions; a federal court vacated the policy in June 2026, an appeals court declined to reinstate it in July, and DHS has since proposed a separate $103,265 fee on H-1B cap-subject petitions through formal rulemaking, according to USCIS's own announcement of the proposed rule, with a public comment period open through September 24, 2026. The underlying proclamation is set to expire by its own terms in September 2026 absent an extension. For employers, the practical result is the same regardless of how the litigation ends: the cost and predictability of hiring through the H-1B program remain in question.

"That gap is what makes nearshore a plan, not a workaround," Guerrero added. "It holds up whether or not a particular visa policy is in effect."
